These Terms of Sale and Service ("Terms") govern your use of thelightstays.com (the "Store") and any purchase you make there. By browsing the Store or placing an order, you confirm that you have read, understood, and accepted these Terms. If anything is unclear, email hello@thelightstays.com before you buy.

1. Who operates the Store

The Light Stays is operated by IRONHAND STUDIO LTDA, registered under CNPJ 26.377.632/0001-62, with its registered office at Avenida Paulista, 1636, 15th Floor, São Paulo, SP 01310-200, Brazil.

2. What we sell

We sell artwork in the sizes, supports, finishes and frame options shown on each product page. The materials and construction of the selected configuration form part of your order.

The relief is part of the image. The print surface is flat. Paper grain and canvas weave are properties of the support, not raised relief in the depicted artwork.

Screen calibration and room lighting can create small differences between the image on your screen and the printed piece; this is normal and is not a defect.

3. Orders and acceptance

Placing an order is an offer to buy. A contract is formed when payment is authorized and we send your order confirmation email.

We may decline or cancel an order, with notice and a full refund, when there is a clear pricing or product-information error, payment cannot be authorized, we reasonably suspect fraud, or the item cannot be fulfilled.

4. Prices and payment

• All prices are in U.S. dollars. Standard shipping is included for eligible U.S. delivery addresses. Available shipping options and the order-specific estimate appear at checkout before payment.
• Applicable sales tax is calculated at checkout based on your shipping address and shown before you pay.
• We never receive or store your full card number; payment is handled by our payment processor.
• Prices may change, but the price that applies to your order is the one in effect when you completed the purchase.

5. Shipping

The delivery estimate for your artwork and address appears at checkout. If we cannot ship within the time promised at purchase, we will notify you with a revised date and you may accept it or cancel the unshipped order for a full refund, consistent with the FTC Mail Order Rule. 6. Returns and refunds

Contact us within 30 calendar days of delivery to request a return. Wait for our instructions before sending the artwork back. Damaged, defective, or incorrect items are fully covered, including return shipping. See our Refund Policy for the complete terms.

7. Warranty and disclaimers

We warrant that your artwork will arrive free from defects in materials and workmanship. If it does not, we will replace it or refund you.

Except as expressly stated in these Terms and as required by applicable law, the artwork and the Store are provided "as is," and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow the exclusion of implied warranties, so these exclusions may not apply to you. You may have other rights that vary from state to state.

8. Intellectual property

Buying an artwork transfers ownership of the physical piece and the right to display it for personal, domestic, decorative use. It does not transfer copyright or any reproduction license.

Without our prior written permission, you may not reproduce, scan, re-print, or copy the artwork; sell copies or reproductions; use its image commercially, including on products, packaging, advertising, or monetized content; or remove attribution.

The brand, site copy, photography, and layout are owned by The Light Stays or used under license. For commercial display or licensing, email hello@thelightstays.com.

9. Customer account

An account is optional for checkout. If you create one, keep your credentials secure and notify us if you suspect unauthorized use. We may suspend accounts used fraudulently or in violation of these Terms.

10. Acceptable use

You may browse the Store and share links to its public pages. You may not interfere with security, use another person's payment information without authorization, scrape the Store at scale, introduce malicious code, or use the Store for any unlawful purpose.

11. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, or consequential damages. Some states do not allow these limitations, so they may not apply to you.

We are responsible for the product and its delivery, including damage or loss in transit. We are not responsible for events outside our control, or for use of the artwork contrary to installation and care instructions.

12. Privacy

Our Privacy Policy explains how personal information is handled and how to exercise your privacy rights, including rights available under California and other state privacy laws.

13. Changes

We may update these Terms to reflect changes in the Store, our operations, or the law. The current version and its date remain on this page. Changes do not affect orders already confirmed, which are governed by the Terms in effect at confirmation.

14. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. This does not remove any mandatory consumer protection available to you under the laws of your state of residence.

15. Acceptance

By completing checkout, you confirm that you have read and accepted these Terms, the Refund Policy, the Shipping Policy, and the Privacy Policy.
